Introduction

Welcome to PhotoFlow ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our photography platform, which allows photographers to upload, manage, and share photos with their clients. By accessing or using PhotoFlow, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Eligibility

You must be at least 18 years old to use PhotoFlow. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using PhotoFlow on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To use certain features of PhotoFlow (e.g., uploading photos, sharing albums), you must register for an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activities that occur under your account. If you suspect unauthorized use of your account, please notify us immediately at support@photoflow.com.

3. Use of Services

PhotoFlow allows you to upload photos, generate branded versions, share albums with clients via secure links, and enable clients to select photos. You agree to use our services only for lawful purposes and in accordance with these Terms. You may not:

• Upload or share content that is illegal, harmful, offensive, or infringes on the rights of others (e.g., copyright, privacy).
• Attempt to gain unauthorized access to our systems or interfere with the proper functioning of PhotoFlow.
• Use our services to distribute malware, spam, or other malicious content.
• Reproduce, modify, or distribute any part of PhotoFlow without our prior written consent.

4. User Content

You retain ownership of the photos and content you upload to PhotoFlow ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely to provide our services (e.g., generating branded photos, sharing albums with clients). We do not claim ownership of your content, and you are responsible for ensuring that your content does not infringe on the rights of others.

5. Payment and Subscription

PhotoFlow operates on a subscription model. By subscribing, you agree to pay the applicable fees (e.g., ₹700/month) as outlined during the registration process. All payments are non-refundable except as required by law. We may change our subscription fees at any time, and we will notify you of any changes in advance. Failure to pay subscription fees may result in suspension or termination of your account.

6. Intellectual Property

PhotoFlow, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of PhotoFlow without our prior written permission. The branded photos generated by our platform include watermarks or other identifiers that must not be removed.

7. Termination

We may suspend or terminate your account at our discretion if you violate these Terms, fail to pay subscription fees, or engage in activities that harm PhotoFlow or its users. You may terminate your account at any time by contacting us at support@photoflow.com. Upon termination, your access to PhotoFlow will cease, and we may delete your data in accordance with our Privacy Policy.

8. Limitation of Liability

PhotoFlow is provided "as is" without warranties of any kind, express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of PhotoFlow, including loss of data, profits, or business opportunities. Our total liability to you shall not exceed the amount you paid to us in the past 12 months.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of PhotoFlow, your User Content, or your violation of these Terms or applicable laws.

10. Governing Law

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of PhotoFlow shall be resolved in the courts of Mumbai, Maharashtra, India. If you are an international user, you agree to submit to the jurisdiction of these courts.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of PhotoFlow after such changes constitutes your acceptance of the updated Terms.
